These Terms and Conditions apply to all purchases and interactions with the website and services of Clickfirst, trading under the name Conquer Performance Wear, located at Schumanpark 9, Apeldoorn, Netherlands. By using our website and purchasing our products, you agree to these terms.


General Terms and Conditions of Conquer Performance Wear


Article 1 – Definitions

The following definitions apply in these terms and conditions:

  1. Withdrawal period: The period within which the consumer may use their right of withdrawal.
  2. Consumer: The natural person whose actions are not within the course of a profession or business and who enters into a distance contract with Conquer Performance Wear.
  3. Day: Calendar day.
  4. Extended duration contract: A distance contract involving a series of products and/or services, where the obligation to supply or purchase is spread over time.
  5. Durable medium: Any tool enabling the consumer or trader to store information addressed to them in a way that facilitates future consultation and unaltered reproduction of the stored information.
  6. Right of withdrawal: The possibility for the consumer to dissolve the distance contract within the withdrawal period.
  7. Conquer Performance Wear: The entity offering products and/or services to consumers at a distance.
  8. Distance contract: A contract concluded solely through one or more means of distance communication within the framework of a system organized by Conquer Performance Wear for the sale of products and/or services up to and including the conclusion of the contract.
  9. Technique for distance communication: Any means that can be used to conclude a contract without the consumer and trader being in the same place at the same time.

Article 3 – Applicability

  1. These general terms and conditions apply to every offer made by Conquer Performance Wear and every distance contract realized between Conquer Performance Wear and a consumer.
  2. Prior to the conclusion of a distance contract, the text of these general terms and conditions will be made available to the consumer. If this is not possible, Conquer Performance Wear will indicate how the terms can be accessed electronically or sent to the consumer free of charge upon request.
  3. In cases where specific product or service-related terms apply, these will complement the general terms. In the event of any contradiction, the most favorable terms for the consumer apply.
  4. In case of ambiguity or questions about these general terms, the consumer is advised to contact Conquer Performance Wear.
  5. If any clause of these terms is deemed invalid by a court, the remainder of the terms will still apply.

Article 4 – The Offer

  1. If an offer has a limited validity or is subject to conditions, this will be explicitly stated in the offer.
  2. The offer includes a complete and accurate description of the products and/or services provided, enabling consumers to make a well-informed decision. Images used for products or packaging are illustrative, and while Conquer Performance Wear strives for accurate color representation, exact color matching cannot be guaranteed due to device display differences.
  3. The offer includes all relevant details:
    • Price, including taxes
    • Any delivery costs
    • The method of payment, delivery, and contract conclusion
    • Whether or not the right of withdrawal applies
    • The period of validity of the offer

Article 5 – Product Information and Prices

We strive to ensure all product information is accurate and up-to-date. All prices on the website are inclusive of VAT and exclusive of any shipping costs. We reserve the right to correct any errors in pricing or availability.

Images and Colors: The images of our products (and their packaging) on our website and app are for illustrative purposes only. We make every effort to ensure that colors are displayed accurately, but we cannot guarantee that the colors on a device will match our products exactly.


Article 6 – Order Process and Payment

  • Ordering: To place an order, select the desired product and complete the online order process.
  • Payment: We accept various payment methods, including [list accepted payment methods]. The order is only final after full payment has been received.
  • Confirmation: After placing an order, you will receive a confirmation via email.

Article 7 – Delivery and Shipping Times

Article 8 – The Contract

  1. The contract is concluded when the consumer accepts the offer and all specified conditions are met.
  2. If the consumer accepts the offer electronically, Conquer Performance Wear will confirm receipt promptly. Until this confirmation, the consumer may dissolve the contract.
  3. Conquer Performance Wear implements secure data transfer measures for electronic payments and personal information.
  4. Conquer Performance Wear may decline a contract based on legitimate factors, such as inability to fulfill payment obligations or unavailability of stock.
  5. Orders may be cancelled within 14 days at Conquer Performance Wear’s discretion.

Article 9 – Right of Withdrawal

  1. The consumer may dissolve a purchase contract within 14 days of receiving the product without providing reasons.
  2. During this period, the consumer must handle the product and packaging with care. They may inspect the product only to the extent necessary to evaluate it.
  3. Certain products are exempt from return and right of withdrawal, including:
    • Swimwear, underwear, bottles, and shakers due to health, safety, and hygiene standards.
    • Products sealed for health protection or hygiene (e.g., socks) if unsealed or labels removed.
    • Customized or personalized items.
    • Items that are damaged, used, or without original labels/packaging.
  4. The consumer is responsible for the return of goods, including costs and ensuring a secure, trackable shipment.

Article 10 – Costs in Case of Withdrawal

  1. If the consumer uses their right of withdrawal, they will bear the costs of returning the goods.
  2. Conquer Performance Wear will reimburse payments within 14 days after receiving the returned items in acceptable condition.

Article 11 – Exclusion of Right of Withdrawal

The right of withdrawal may be excluded for specific products:

  1. Products created to the consumer's specifications or that are personal in nature.
  2. Items showing signs of use inconsistent with examination for purchase consideration.

Article 12 – Pricing

  1. Prices listed include VAT and remain valid for the offer's duration.
  2. Conquer Performance Wear reserves the right to adjust prices for reasons like tax changes.
  3. For price increases after a contract's conclusion, the consumer may terminate the contract if the increase occurs more than three months post-contract and is unrelated to legal or tax changes.

Article 13 – Conformity and Guarantee

  1. Conquer Performance Wear guarantees product quality and conformity with the offer specifications. A 24-month warranty covers manufacturing defects.
  2. The warranty excludes issues resulting from misuse, unauthorized repairs, or consumer-caused damage.
  3. Defects or incorrect items must be reported within 7 days.

Article 14 – Delivery and Implementation

  1. Conquer Performance Wear ensures careful processing of orders and strives to deliver within 30 days unless agreed otherwise.
  2. In case of delay, the consumer may dissolve the contract, with a refund processed within 30 days.
  3. Risk of damage or loss transfers to the consumer upon delivery, except where otherwise agreed.

Article 15 – Payment

  1. Payment is due within 14 days unless otherwise agreed.
  2. If an advance payment is required, it will not exceed 50%, and the consumer has no contract rights until payment is received.
  3. Payment errors should be reported promptly.
  4. In case of non-payment, Conquer Performance Wear may charge reasonable fees and suspend or cancel the order.

Article 16 – Complaints Procedure

  1. Conquer Performance Wear has a publicly available complaints procedure, with complaints addressed within 14 days.
  2. If a complaint cannot be resolved, it may be treated as a dispute under the applicable settlement scheme.

Article 17 – Disputes

  1. Contracts between Conquer Performance Wear and consumers are governed by Dutch law, excluding the CISG.
  2. Disputes will first be attempted to be resolved mutually before escalation to a competent court.

Article 18 – Additional or Deviating Provisions

Additional or alternative provisions may apply, provided they are not detrimental to the consumer and are accessible in a durable format.


This document is provided to the consumer electronically and may be saved for future reference. Rights are based on the Dutch version of these general terms.
